These Terms of Service set out the terms on which you may use the Talesoft Digital website and purchase products from the Talesoft Digital store.

Throughout these Terms, “Talesoft Digital”, “we”, “us” and “our” means Talesoft Digital. “You” means the customer, user, or purchaser.

By using our website or purchasing from our store, you agree to these Terms and to our Privacy Policy.

1. About our store

Talesoft Digital sells digital creative products, including lyric videos, visual media, and related downloadable assets. Our store is hosted by Shopify, which provides the ecommerce platform we use to sell our products.

2. Eligibility and information you provide

You must provide accurate, current, and complete information when placing an order or contacting us.

If you create an account, you are responsible for keeping your login details secure and for any activity carried out under your account.

3. Products and descriptions

We aim to describe and display our products as accurately as possible. However, colours, fonts, layouts, and visual appearance may vary depending on your screen, software, or playback environment.

We may update, change, or discontinue products at any time.

4. Orders

When you place an order, you are making an offer to buy. Your order is accepted when payment has been successfully processed and we make the digital product available to you.

We reserve the right to refuse or cancel an order where necessary, including for suspected fraud, pricing errors, product availability issues, or breach of these Terms.

5. Digital delivery

Our products are supplied digitally. No physical item will be shipped unless explicitly stated on the product page.

Delivery is usually made by download link, email, or another digital fulfilment method. It is your responsibility to provide a valid email address and check your spam or junk folder if needed.

6. Licence to use purchased products

When you purchase a product from Talesoft Digital, we grant you a non-exclusive, non-transferable, non-sublicensable licence to use that product for your own internal use within your church, organisation, team, or personal project, subject to these Terms and any product-specific wording on the relevant product page.

Unless we have agreed otherwise in writing, you may not:

resell, redistribute, share, sublicense, or give the files to third parties;

upload the purchased files to stock, template, download, or asset-sharing platforms;

claim the product as your own work;

remove branding or watermarking from preview assets not intended for production use;

use the product in a way that infringes the rights of others.

All intellectual property rights in the products remain with Talesoft Digital unless expressly stated otherwise.

7. Important notice about song rights

Where a product relates to a song, worship track, or other third-party composition, your purchase covers only the visual/video asset created by Talesoft Digital.

Your purchase does not include any copyright, publishing, master, performance, lyric display, recording, streaming, or other rights in the underlying song or composition unless we explicitly state otherwise in writing.

You are responsible for ensuring that you, your church, or your organisation hold any licences or permissions required for your intended use of the underlying song.

8. Custom and third-party elements

Some products may incorporate or reference third-party content, styles, song titles, or metadata. Any rights in those third-party materials remain with their respective owners.

If a product page includes specific usage restrictions, those restrictions form part of these Terms.

9. Refunds

Refunds are handled in line with our Refund Policy, which forms part of these Terms.

Nothing in these Terms removes or limits any statutory rights you may have under applicable law.

10. Acceptable use

You must not use our website or products:

for unlawful purposes;

to infringe intellectual property rights;

to distribute malware, spam, or harmful code;

to scrape, copy, or exploit the site or its contents without permission;

in a way that damages, disables, or interferes with the store or other users.

11. Website availability

We try to keep the website and store available, but we do not guarantee uninterrupted access. We may suspend, withdraw, or change any part of the site where needed.

12. Liability

We do not exclude or limit liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, or for defective digital content where the law gives you rights that cannot be excluded.

Subject to that, our total liability to you in connection with any order or use of the store will not exceed the amount you paid for the relevant product.

We are not liable for indirect or consequential loss, loss of profits, loss of revenue, loss of goodwill, or loss arising from misuse of a product, lack of third-party rights, or incompatibility with software, hardware, or church presentation systems that were not expressly stated as supported.

14. Changes to these Terms

We may update these Terms from time to time by posting a new version on our website. The version in force at the time of your order will apply to that order.

15. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer, you may bring legal proceedings in the courts of the part of the United Kingdom where you live, where applicable. If you are a business customer, the courts of England and Wales will have exclusive jurisdiction unless we agree otherwise in writing.
